• Account Information: Name, email address, phone number, school affiliation, and role (teacher, student, parent, administrator)
• SMS Subscription Information: Phone number, consent records, message preferences, and opt-in/opt-out status
• Educational Data: Student records, grades, assignments, attendance, and related information only when an authorized school or district workspace has activated that processing under its agreement with Faraday
• Communication Data: Messages, feedback, and other communications you send through our platform

2.2 Automatically Collected Information

• Device information (IP address, browser type, operating system)
• Usage data (pages visited, features used, time spent)
• Cookies and similar tracking technologies
• Location data (if permitted)

3. How We Use Your Information

We use the information we collect to:

• Provide and maintain our educational technology services
• Send account alerts and service notifications to users who opt in to the Faraday AI SMS program
• Process transactions and manage accounts
• Improve our services and develop new features
• Communicate with you about your account, services, and updates
• Comply with legal obligations and protect our rights
• Prevent fraud and ensure security

4. SMS Messaging

When you opt in to the Faraday AI Account & Service SMS Alerts program, you consent to receive text messages from Faraday AI, LLC about your own Faraday AI account and service. These messages may include:

• Account alerts and notifications
• Service notifications related to your Faraday AI account

Up to 4 routine messages per month. This program excludes promotional marketing and messages sent on behalf of schools. Message and data rates may apply. You can opt out at any time by replying STOP to any message. Reply HELP or email [email protected] for assistance. Your consent to receive SMS messages is separate from your agreement to our Terms of Service.

5. Information Sharing and Disclosure

No mobile information will be sold or shared with third parties for promotional or marketing purposes.

We do not sell your personal information. We may share your information in the following circumstances:

• With Schools and Educational Institutions: To provide educational services and facilitate communication between teachers, students, and parents
• Service Providers: With third-party vendors who perform services on our behalf (e.g., SMS delivery, cloud hosting)
• Legal Requirements: When required by law, court order, or government regulation
• Business Transfers: In connection with a merger, acquisition, or sale of assets
• With Your Consent: When you explicitly authorize us to share your information

6. Data Security

We use administrative, technical, and organizational safeguards designed to protect information, including encryption in transit, access controls, data-minimization controls, and security review. No method of transmission or storage is completely secure.

7. Children's Privacy

Faraday's general and personal workspaces are not authorized for real student records. Processing information from or about students under 13 requires an authorized school or district workspace, a written agreement, and verified school authority or another legally valid basis. Where Faraday processes education records for an institution, Faraday uses them only to provide the contracted educational service and does not sell them or use them for targeted advertising. The institution remains responsible for providing required notices and obtaining any consent that the law assigns to it.

8. Your Rights and Choices

You have the right to:

• Access and review your personal information
• Correct inaccurate information
• Request deletion of your information (subject to legal and contractual obligations)
• Opt out of SMS messages by replying STOP
• Opt out of marketing communications
• Request a copy of your data

9. Data Retention

We retain information only for the period associated with the applicable service, security, legal, and contractual purpose. An authorized school or district workspace must have a documented retention period before real education records can be processed. Personal and synthetic-demo workspaces must not contain real student records. Contract-specific deletion, return, and legal-hold obligations control where they apply.

10. International Data Transfers

Information may be processed in locations where Faraday and its service providers operate. For an institutional workspace, permitted processing locations and any required transfer safeguards are governed by the applicable agreement and disclosed subprocessor terms.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the updated Privacy Policy.
